1. Acceptance of Terms
By accessing this website or using our plugins, you confirm that you are at least 18 years old (or the legal age of majority in your jurisdiction), have the authority to enter into these Terms, and agree to be bound by them. If you do not agree, please do not use our products.
2. Products and Services
Winalt Technologies provides:
- WinaltChat (Free Plugin): A free, open-use WordPress plugin for WooCommerce stores. It is provided as-is with no license key requirement and no expiry.
- WinaltChat Pro (Paid Plugin): A premium WordPress plugin requiring a valid license key for Pro features (analytics dashboard, revenue attribution, weekly reports, lead capture, and feedback learning).
- License Keys: Issued via aisalesmanchatpro.com upon confirmation of payment. Keys are valid for the subscription period agreed at the time of purchase (monthly or annual).
3. License Keys and Subscriptions
Pro Access: Access to WinaltChat Pro features requires a paid license key. To obtain a key, submit your interest via the form at aisalesmanchatpro.com. We will contact you by email with payment options. Your license key will be issued once payment has been arranged and confirmed.
Paid Subscriptions: Paid license keys are billed monthly or annually as agreed at the time of purchase. Subscriptions automatically renew unless cancelled before the renewal date. Pricing is subject to change with 30 days' notice to active subscribers.
One Domain Per Key: Each license key activates on one live domain at a time unless your plan explicitly states otherwise (e.g., Agency plan). You may deactivate a key from one domain and activate it on another, but simultaneous multi-domain use is not permitted under standard plans.
Key Revocation: We reserve the right to revoke a license key if it is shared, resold, used in violation of these Terms, or if a payment fails and is not resolved within 14 days.
4. Acceptable Use
You agree to use our products only for lawful purposes and in accordance with these Terms. You must not:
- Share, resell, or distribute license keys to third parties
- Attempt to reverse-engineer, decompile, or circumvent the license validation system
- Use the plugins to collect personal data from end users without proper disclosure and consent under applicable privacy laws (e.g., GDPR, CCPA)
- Use the plugin's API integration features to transmit harmful, illegal, or abusive content to AI providers
- Misrepresent your identity, domain ownership, or payment information when obtaining a license key
5. Third-Party AI Providers
Our plugins support integration with third-party AI APIs including Groq, OpenAI, Anthropic (Claude), and Google (Gemini). When you configure such an integration:
- You are responsible for obtaining your own API key and complying with that provider's terms of service and usage policies.
- You are responsible for any costs charged by the AI provider for API usage.
- Winalt Technologies is not affiliated with, endorsed by, or responsible for any third-party AI provider.
- Customer chat messages may be transmitted to the configured AI provider's servers. You are responsible for ensuring your store's privacy policy discloses this to your customers.
6. WooCommerce Requirement
Both the WinaltChat and WinaltChat Pro plugins require WooCommerce to be installed and active. Winalt Technologies is not affiliated with WooCommerce or Automattic. You are responsible for ensuring your WordPress and WooCommerce installations are up to date and secure.
7. Intellectual Property
All code, designs, documentation, and content associated with WinaltChat and WinaltChat Pro are the intellectual property of Winalt Technologies. You are granted a limited, non-exclusive, non-transferable license to install and use the plugin on authorized domains in accordance with your plan. This license does not grant you ownership of the software.
8. Refunds
Refund eligibility is governed by our Refund Policy, which is incorporated into these Terms by reference. Generally, we offer refunds within 14 days of purchase if the plugin cannot be made to work on your site after contacting our support team.
9. Disclaimer of Warranties
The WinaltChat and WinaltChat Pro plugins are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the plugins will be error-free, uninterrupted, or free of security vulnerabilities. We do not guarantee that the AI responses generated (whether by Basic AI mode or Real AI mode) will be accurate, complete, or suitable for any particular purpose.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Winalt Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, loss of customers, or loss of business opportunities, arising from your use of our products, even if we have been advised of the possibility of such damages.
Our total cumulative liability for any claim arising from your use of our products shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100 USD, whichever is greater.
11. Indemnification
You agree to indemnify, defend, and hold harmless Winalt Technologies and its officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from: (a) your use of our products in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) any content or data you process through the plugins.
12. Privacy
Your use of our website and products is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
13. Termination
You may stop using our products at any time. For paid subscriptions, see the Refund Policy for how to cancel and what refunds may apply.
We may suspend or terminate your access to WinaltChat Pro if: you violate these Terms, a payment fails and remains unresolved for 14 days, or we discontinue the product (in which case we will provide reasonable advance notice where practical).
Upon termination of a paid license, your license key is deactivated. Data already stored in your own WordPress database (chat history, analytics) is not affected, since it resides on your site, not ours — see our Privacy Policy for how we handle any data we hold ourselves.
14. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any aspect of our products or services at any time with or without notice. We will endeavour to give reasonable advance notice for significant discontinuations affecting paid subscribers.
15. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect any changes. Continued use of our products after changes are posted constitutes your acceptance of the revised Terms.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Winalt Technologies is registered, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
